Can my motability car be clamped on private property?

I was forced to park out of a bay at my daughters apartment as the disabled bays were occupied by non disabled cars/users, unfortunately my blue badge is out of date I just couldn afford to pay renewal fee .. I know it's going to cost me more in the long run..but sometimes u just cant afford what some people consider to be a small amount. I was clamped although I parked as polietly as I could without blocking anyone or any access. I took a while to get down to the man who came out from the clamp company as I am slow to move being disabled, my kids were all outraged and according to the clamp man told him they were going to remove the clamp, not that they would be able to without some serious equipment. I tried to pay him and recorded him refusing to accept my payment saying that it was no longer £125 it was now £325 as my kids had threatend to remove the clamp he had called the tow truck... I explained to him why I had parked there, asked why he hadnt clamped the cars parked in the disabled bays, and why he hadnt the patience to wait for me to get down to him to discuss matters. I told him I was going to record his responses to my questions and did so asking why he wouldnt accept my payment, why he clamped what was clearly a disabled persons car... To make matters worse, he drove off so I had to go upstairs again when I came down the clamp had been removed, and I thought that he had finally realised that I had no option but to park where I did. I then got a phone call somewhat odd, calling me by my christian name claiming to be the police, saying he wanted to talk to me before creating a case of criminal damage for damaging the clamp and that he said he had tried ringing me and my husband who wasnt even with me before creating a case number....and he kept saying that I must be remember to always tell the truth when questioned and that some people will be arrested as a consequence of the clamp being removed. I dont know who removed the clamp but am grateful that they did, does anyone know where I stand legally etc, etc???

You should just not have parked there should you. The car was not clearly a disabled persons car as it did not have a current blue badge.

If you did not damage the clamp then they can have no evidence that you did so and you cannot be prosecuted - it would be a Police matter if anything was to be done about it.

The owners/managers of apartment blocks often employ firms to deal with unacceptable parking on their property, often involving clamping or removal of offending vehicles. There should be clearly visible warning signs - were there?



If there were, in a nutshell you parked out of bay and without displaying a valid blue badge. Looks like they've got you. You may want to speak to the CAB for advice.

If you put any vehicle (regardless of what it is) on private property, you're in the wrong so I guess I could be clamped for that.
