take it elsewhere, get an independant report, then take it back.

they will NEVER find fault with one of their own sales.

if their is a fault with it, tell them you want a full refund, plus cost of independant report and finance agreement cancelled.

If you quote this, watch for a look of panic in their faces, ready...

Under the "sales of goods act 1979, section 2,subsection 14,paragraphs2, 2A,2B,2C,these goods are not fit for purpose, and therefore being returned and the contract will be cancelled"

sales of goods act i've quoted says,

2 - must be of satisfactory condition when being sold

2A - must be good quality,

2B - fit for purpose, free from "minor" defects, reliable

2C - any faults should have been drawn to your attention



if you go in, having done a bit of research, you should be able to get a better car for same money, or get all your money back

these are questions you need to be asking the dealer.

lemon laws usually do not pertain to a used car.

as for fix, it can be faulty wiring, faulty ecm, faulty alternator, bad connections, security system issues, neutral/park safety/clutch safety, or starter solenoid.

it is even possible you have a small amount of coolant in the combustion chamber, or the starter itself is going bad.

your dealer doesnt have a very good mechanic.

Don't feel bad.

I bought my wife a brand new [can't say because of slander laws]

In the first three months it's been in their service department for 26 days.Even now it still has problems with software that the manufacturer can't fix.What I'm saying here is newer isn't necessarily better.

Without details,it sounds like you may basically be stuck with what you have because it's a used car.They are obligated to honor your warranty,that's probably all.I will say that my new vehicle had the same symptoms as your used one.After much ado with several jump starts and tows,they finally cured it with a new starter.The existing one was intermittent.I would request that yours be replaced even if they don't agree.

Annoying but I can't see them giving you a refund or replacement. They may allow you to put it in for part exchange for a more expensive model but I suspect they would offer you a very poor price. The log book would now show another owner ie yourself. Why not get one of the Motoring organisations to give you an independent survey as to what may be wrong with it. They're not terribly expensive. Perhaps the Battery is OK, but what about the Altertanator, perhaps that's faulty and could be expensive to replace. Good luck.

Just had the Alternator replaced on my Focus @ £450.

EMMA for GOD's SAKES, include the MAKE, MODEL, engine size, COUNTRY OF ORIGIN, and MILEAGe here! WHAT KIND OF BREAKDWON are you having! Does this engine have a TIMING BELT or CHAIN! MORE DETAILS PLEASE! Start by having the THROTTLE BODY and the IDLE AIR CONTROL VALVE cleaned up to SOWROOM CLEAN! THE FINAL AIR/FUEL MIXTURE OCCURS THROUGH THE WORKING iac valve! What type of car was it? A lot of car brands are faulty all together. Yes you are entitled to a refund since you have a warranty.

some states have a "lemon law". your car could have been a hurricane Sandy salvage car. did you get a carfax on it when you bought it

Under U.K. consumer law, if you had wanted a refund or a replacement, you you would have had to request it on the FIRST occasion that you returned the vehicle to the dealer. As you have now allowed them to carry out work on the car, you are deemed to have "accepted" it in law and it is too late to ask for a refund or a replacement car. The best you can hope for is that they can find and cure the problem soon.
